Արտառոց դեպք. Արմավիրում 12-ամյա դստեր հետ մոր առջև ...

Նախաքննության ընթացքում պարզվել է, որ 37-ամյա տղամարդը 2013 թվականին տարբեր առիթներով հաճախակի այցելել է Արմավիրի մարզի մի ընտանիք, ծանոթացել նշված ընտանիքի անչափահաս 3 երեխաների հետ։ Այցելությունների ընթացքում տղամարդու և երեխաների մոր միջև ձևավորվել են ինտիմ հարաբերություններ, ինչի մասին իմացել է վերջինիս ամուսինը, որն էլ դարձել է վիճաբանության պատճառ։ Կինը հեռացել է ամուսնու տնից և բնակարան վարձակալել, որտեղ սկսել է համատեղ ապրել 37-ամյա տղամարդու հետ: Որոշ ժամանակ անց մոր մոտ բնակության են տեղափոխվել նաև երեք երեխաներից երկուսը՝ 10-ամյա որդին և 13-ամյա աղջիկը։
Նախնական քննությամբ ձեռք բերված ապացույցների համաձայն՝ 37-ամյա տղամարդը համատեղ բնակվելու ընթացքում՝ 2013թ. օգոստոսից մինչև 2014թ. դեկտեմբերի 29-ն ընկած ժամանակահատվածում, պարբերաբար անառակաբարո գործողություններ է կատարել իր հետ փաստացի ամուսնական հարաբերությունների մեջ գտնվող կնոջ 13-ամյա դստեր նկատմամբ, ինչը շարունակվել է նաև նրա 14 տարին լրանալուց հետո՝ մինչև 2015թ. մայիսը։
Տղամարդու նշված գործողությունների մասին իմացել է 13-ամյա աղջկա ավագ քույրը (ծնված 1996թ.), ով 2013թ. նոյեմբերի կեսերին նշված հարցի շուրջ վիճաբանել է նրա հետ։ Վերջինս ավագ քրոջը պատժելու նպատակով ապօրինի զրկել է նրան ազատությունից` մեկ գիշեր պահել է տան նկուղում: Քրոջը նկուղից ազատել է փոքր եղբայրը հաջորդ օրն առավոտյան, երբ տղամարդը տնից բացակայել է։
Քննությամբ պարզվել է նաև, որ տղամարդը 2013թ. նոյեմբերից մինչև 2014թ. գարունն ընկած ժամանակահատվածում ստիպել է նաև կնոջ անչափահաս որդուն՝ 10-ամյա տղային, Արմավիր քաղաքում զբաղվել մուրացկանությամբ, որի արդյունքում գոյացած գումարն ստացել ու ծախսել է իր անձնական կարիքների համար:
Տղամարդու կողմից անչափահասների նկատմամբ ոտնձգությունները դադարել են՝ անչափահաս երեխաների ուսումը շարունակելու համար 2015թ. ապրիլին նրանց հատուկ կրթահամալիր տեղափոխվելուց հետո:
Կատարվածի մասին անչափահաս աղջիկը հայտնել է կրթահամալիրի հոգեբանին, իսկ 2015թ. հունիսի 15-ին գրավոր հաղորդում է ներկայացրել ավագ քույրը։
Մինչդատական վարույթում ձեռք բերված ապացույցների համակցությամբ` 37-ամյա տղամարդուն մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 132.2-րդ հոդվածի 1-ին մասով, 133-րդ հոդվածի 2-րդ մասի 4-րդ կետով, 142-րդ հոդվածի 2-րդ մասի 3-րդ, 4-րդ կետերով և 142-րդ հոդվածի 2-րդ մասի 2-րդ և 4-րդ կետերով։ Նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:
Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին, մեղադրական եզրակացությունը հաստատվել է, և գործն ուղարկվել Արմավիրի մարզի ընդհանուր իրավասության դատարան:
