Արդարադատության քննությունը․ Սամվել Կարապետյանի գործը և իրավական պետության ճգնաժամը Հայաստանում

Հայաստանը, որը միջազգային հարթակներում հաճախ ներկայացվում է որպես ժողովրդավարական արժեքների կրող երկիր, այսօր կանգնած է իր արդարադատական համակարգի ամենախորքային քննության առջև։ Աշխարհահռչակ ավստրալա-բրիտանացի փաստաբան և իրավաբան-գիտնական Ջեֆրի Ռոբերտսոնը՝ King’s Counsel տիտղոսակիր փորձագետը, հրապարակավ հայտարարեց, որ Սամվել Կարապետյանի նկատմամբ իրականացվող քրեական հետապնդումը իրավական առումով լիովին անհիմն է։

Ռոբերտսոնի խոսքով՝ «ցանկացած բանական դատավորի համար ակնհայտ է, որ Սամվել Կարապետյանը ոչ մի անօրինական բան չի արել»։ Նրա միակ «մեղքը» եղել է հանրային հարցի շուրջ իր կարծիքը հայտնելը՝ արձագանքելով վարչապետի սադրիչ հայտարարություններին եկեղեցու և նրա աջակիցների դեմ։

Իրավաբանն ընդգծում է, որ Սամվել Կարապետյանի կողմից արված հայտարարությունները որևէ կերպ չեն պարունակել կոչեր բռնության, ապստամբության կամ իշխանության զավթման մասին։ Դրանք առավելագույնը եղել են հանրային դիրքորոշում՝ ուղղված Հայ Առաքելական Եկեղեցու պաշտպանությանը, ինչը ժողովրդավարական երկրում դիտվում է որպես խոսքի ազատության լիարժեք դրսևորում։

«Ոչ մի ժողովրդավարական երկրում, որտեղ խոսքի ազատությունը երաշխավորված է Սահմանադրությամբ, չի կարող պնդվել, թե պարոն Կարապետյանի արտահայտած կարծիքները ենթադրում են հանցանք», — ընդգծել է Ռոբերտսոնը։

Իրավական գնահատմամբ, Հայաստանի Քրեական օրենսգրքի 422-րդ հոդվածը («իշխանությունը զավթելու կոչեր») կիրառվել է խախտմամբ։ Այս հոդվածը պահանջում է ապացույց, որ հնչել է ուղիղ կոչ բռնությամբ տապալելու սահմանադրական կարգը, մինչդեռ Սամվել Կարապետյանի խոսքում նման բան պարզապես չկար։

Ռոբերտսոնի վերլուծությամբ՝ սա ոչ միայն հակասում է Հայաստանի Սահմանադրությանը, այլև Մարդու իրավունքների եվրոպական կոնվենցիայի 10-րդ հոդվածին, որը պաշտպանում է խոսքի ազատությունը հատկապես պետական ղեկավարների հասցեին հնչող քննադատության դեպքում։ Եվրոպական դատարանի նախադեպային որոշումները ևս հաստատում են՝ կառավարությունների նկատմամբ քննադատության սահմանները միշտ ավելի լայն են, քան մասնավոր անձանց նկատմամբ։

Փաստաբանը խիստ քննադատում է նաև դատարանների վարքագիծը՝ ընդգծելով, որ Կարապետյանին ապօրինի կերպով պահել են կալանքի տակ ավելի քան 100 օր, մերժելով գրավի դիմաց ազատ արձակելու միջնորդությունները։ «Դատարանները չեն անդրադարձել մեղադրանքի անհիմնությանը, ինչը լուրջ կասկածի տակ է դնում Հայաստանի դատական համակարգի անկախությունը», — հայտարարել է նա։

Ռոբերտսոնի եզրակացությունը միանշանակ է․ Սամվել Կարապետյանի շարունակական կալանքը հակասում է մարդու հիմնարար իրավունքներին, իսկ գործը՝ որպես ամբողջություն, վկայում է իշխանության կողմից պետական իրավական համակարգի օգտագործման մասին՝ ընդդիմախոսներին լռեցնելու նպատակով։

Այս գործը վաղուց անցել է մեկ անձի կամ մեկ հայտարարության շրջանակները։ Այն դարձել է Հայաստանի արդարադատության համակարգի իրական ստուգումը՝ արդյո՞ք մեր պետությունը ունակ է պաշտպանել խոսքի ազատությունը, երբ խոսքը քննադատում է իշխանությանը։

Եթե դատարանները շարունակեն ծառայել քաղաքական պատվերներին, ապա իրավական պետության մասին խոսելն արդեն պարզապես ձևականություն կլինի։

Սամվել Կարապետյանի գործը ոչ միայն անհատի, այլև ամբողջ հասարակության իրավունքի քննությունն է՝ ազատորեն արտահայտվելու՝ առանց վախի և հալածանքի։
