«ԶԼՄ հրապարակումն արդեն հիմք է վարույթ սկսելու». Արտակ Սարգսյանը՝ քննիչների սպառնալիքների մասին. «Փաստ»

Հայաստանյան քաղաքական դաշտում նոր քննարկումների առիթ է դարձել «Քոչարի» կուսակցության նախագահ Արտակ Սարգսյանի կողմից արված հայտարարությունը, ըստ որի՝ քննիչները իրեն սպառնացել են «զենք գցել» իր տան կամ մեքենայի մեջ։ Քաղաքական գործիչը մի քանի օր առաջ այդ հայտարարությունը ներկայացրել էր հրապարակայնորեն՝ ԶԼՄ-ների միջոցով, ինչը, ըստ գործող օրենսդրության, արդեն իսկ համարվում է հանցագործության մասին հաղորդում։

«Փաստ»֊ը այս համատեքստում հետաքրքրվել է, արդյո՞ք նման ծանր մեղադրանքի հրապարակումից հետո իրավապահ մարմինները որևէ գործողություն իրականացրել են, և արձանագրվել են արդյո՞ք իրավական հետևանքներ։

Պատասխանելով հարցին՝ Արտակ Սարգսյանը նշեց, որ ՀՀ օրենսդրությունը հստակ պարտավորեցնում է իրավապահ մարմիններին գործել անգամ այն դեպքում, երբ բողոք ներկայացնողը չի դիմել գրավոր։

«Այո, նման սպառնալիք հնչեցվել է, և դա ես հրապարակայնորեն ներկայացրել եմ մամուլի միջոցով։ Ըստ ՀՀ Քրեական դատավարության օրենսգրքի 180-րդ հոդվածի 1-ին և 4-րդ մասերի՝ հանցագործության մասին հաղորդումը կարող է հաղորդակցվել զանգվածային լրատվության միջոցներով, և այդ դեպքում վարույթն իրականացնող մարմինը պարտավոր է ստուգել հրապարակման իսկությունը և որոշում կայացնել՝ քրեական վարույթ հարուցել կամ մերժել։ Բացի այդ, նույն օրենսգրքի 181-րդ հոդվածի 1-ին և 2-րդ մասերով հստակ ամրագրված է, որ վարույթն իրականացնող մարմինը պարտավոր է անմիջապես արձագանքել ԶԼՄ-ներում հրապարակված հանցագործության հատկանիշներ պարունակող տվյալներին և իրականացնել պարտադիր ստուգում։
Այսինքն՝ տվյալ դեպքում օրենսդրությունը չի պայմանավորում վարույթի սկսումը բողոք ներկայացնողի առկայությամբ․ ԶԼՄ-ում հրապարակված հաղորդումը ինքնին համարվում է վարույթ սկսելու հիմք»,– ընդգծեց Սարգսյանը։

Նրա խոսքով՝ եթե հրապարակայնորեն ներկայացվել է, որ քննիչները սպառնալիք են հնչեցրել՝ «զենք գցելու տան կամ մեքենայի մեջ», ապա ներքին անվտանգության վարչության, հակակոռուպցիոն, դատախազական և քննչական մարմինների, պարտականությունն է եղել սեփական նախաձեռնությամբ սկսել վարույթ կամ առնվազն որոշում կայացնել դրա վերաբերյալ։

«Մինչ այս պահը որևէ իրավական հետևանքի բացակայությունը փաստում է, որ տվյալ օրենսդրական պահանջները չեն կատարվել։ Այժմ արդարացիորեն հարց է առաջանում՝ ուր է վարույթը, ո՞ւր է դատախազության արձագանքը, և ինչու է օրենքով նախատեսված պարտադիր ընթացակարգը անտեսվել։ Ես կրկին վերահաստատում եմ իմ հրապարակած խոսքերի իսկությունը և պահանջում եմ, որ օրենքը գործի՝ առանց ընտրողական մոտեցման»,– նշեց Արտակ Սարգսյանը։

Նրա գնահատմամբ՝ եթե նման դեպքերից հետո պետական մարմինները չեն արձագանքում, ապա դա ոչ միայն իրավական պետության սկզբունքների դեմ է, այլ նաև վտանգավոր նախադեպ է ստեղծում՝ լեգիտիմացնելով սպառնալիքներն ու հնարավոր ապօրինությունները։
